Q.   If I am injured in an auto accident in which I am issued a traffic ticket does the ticket prevent me from seeking compensation for my injuries and damages?

A.   No. A traffic ticket does not determine liability and is not considered in a 
      claim for damages.  Liability for the accident is determined by the actions 
      of all parties involved.
In some accidents one motorist is completely
      liable and in others more than one party
shares liability.


Q.   If I am injured in an auto accident who pays for my medical treatment expenses and lost wages?

A.   Under Florida law, each motorist is required to carry PIP coverage and this coverage pays for medical treatment expenses and wage loss.  Any PIP deductible cannot be reimbursed and the amount of the deductible represents expenses, which cannot be recovered through a legal action.

 

Q.   If I become injured at work must my employer furnish a written report to any agency or authority?

A.   Yes. Under Florida Worker’s Compensation Law if you are injured at work for any reason you should immediately report the incident to a supervisor.  Your employer has a duty to prepare a notice of injury report and record it with the Division of Administrative Hearings (DOAH).
